The Public Procurement Appeals Authority commonly known by its acronym  PPAA  was initially  established  under the then Public Procurement Act No. 3 of 2001 as a department under the Ministry of Finance. The said Act was later on repealed and replaced by the Public Procurement Act No 21 of 2004. The 2004 Act was also repealed by the Public Procurement Act No. 7 of 2011 which establishes the Appeals Authority as an independent procurement Appeals Authority. The aim ofestablishing Appeals Authority  is  to provide for an independent mechanism through which complaints and disputes arising in public procurement could be solved within the shortest possible time. In clear terms the Appeals Authority can be termed as a quasi judicial body responsible for determining complaints/Appeals arising from public

procurement processes with a view to check compliance with the law. (S.88(5) of PPA 2011). The Appeals Authority is also vested with powers to determine all complaints arising from blacklisting of tenderers. (S.62(6) of PPA 2011).The Appeals Authority is required to determine Appeals or complaints within forty five days from the date submitted pursuant to Section 97(6) of the Public Procurement Act. The time provided for determination of complaints ordinarily is expected to be shorter than the time taken in the ordinary courts of law due to less legal technicalities involved in the determination process. The decision of the Appeals Authority is final unless the dissatisfied party goes for judicial review pursuant to Section101 of the Public Procurement Act. The shorter time taken by the Appeals Authority in determining procurement complaints allows speedy decisions and lower costs; and at the same time  ensures attainment of value for money in public procurement and quick execution of public procurement contracts.
